Smowka Terms and Conditions

By accessing or using Smowka, you (user or merchant) fully agree to these Terms and Conditions. Rules and requirements may vary by country and local law.

Transparency Security Accountability Global Compliance

1. Nature of the Platform

Smowka is a digital marketplace that acts solely as a technological intermediary. We connect consumers with independent partner stores such as smoke shops, bars, convenience stores, markets, and restaurants. Smowka does not manufacture, store, sell, handle, or deliver any products listed. Its role is to provide the virtual environment for locating stores, browsing items, placing orders, and choosing between delivery, pickup, or local consumption.

Because laws differ, features and policies may vary per jurisdiction, including payment options, visible categories, and age or identity verification requirements.

2. Merchant Responsibilities

  • Accuracy of product descriptions, prices, promotions, and availability.
  • Preparation, packaging, storage, quality, safety, labeling, and delivery.
  • Holding all licenses and authorizations required by local law.
  • Verifying the buyer’s age and identity for restricted goods (e.g., alcohol or tobacco).
  • Compliance with intellectual property laws and use of original content only.

Smowka does not guarantee delivery times, stock availability, quality, or legal compliance of listed products. Visibility of restricted items (like rolling papers or tips) may require login and/or age verification, depending on the country.

3. Orders, Delivery, and Payments

Deadlines, service areas, and rates are determined by each merchant. Issues such as delays or product dissatisfaction must be resolved directly with the merchant. Smowka may facilitate communication when possible.

Payments processed within the platform are transferred to the merchant, minus applicable fees. Smowka does not act as a seller, distributor, or logistics provider. Payments made outside the platform are entirely the responsibility of the merchant and user, with no reimbursement obligations by Smowka.

4. Brand and Content Usage

By registering a store and its products, the merchant grants Smowka the right to use, edit, and display the brand name, logo, descriptions, and product images for marketing, listing, and promotional purposes in any media—digital or print—while the store remains active. This authorization is non-exclusive and free of charge.

5. Restricted and Prohibited Items

  • Restricted (login required): rolling papers, tips, filters, grinders, ashtrays, and similar accessories legally allowed.
  • Prohibited (no exception): vapes/e-cigarettes and related refills, drugs, narcotics, weapons, explosives, political content, offensive/discriminatory materials, counterfeit goods, IP violations, and public display of external contacts or links.

Smowka may suspend, hide, or remove listings that violate these rules and may notify authorities in severe cases (e.g., sale of illegal or prohibited goods).

6. User Obligations

  • Be of legal age to buy restricted goods under local law.
  • Provide truthful information and keep credentials secure.
  • Use the platform ethically and lawfully.
  • Do not circumvent region, age, or login restrictions.

7. Intellectual Property

Smowka and its licensors retain all rights to its brand, layout, code, text, and visual elements. Users are granted a limited, revocable, non-exclusive license for personal use only. Unauthorized reproduction, reverse engineering, scraping, or API misuse is forbidden.

8. Privacy and Data Protection

Use of the platform is subject to the Privacy Policy. Practices and rights vary by jurisdiction (e.g., GDPR, LGPD). For questions, contact [email protected].

9. Liability Limitations

Smowka is provided “as is”. To the fullest extent allowed by law, Smowka is not liable for direct, indirect, incidental, consequential, or punitive damages arising from the use of the platform, including delivery failures, product defects, service unavailability, or any actions by third-party merchants or partners.

10. Updates and Continuity

Smowka may update these Terms or modify features at any time. Continued use after updates implies full acceptance. Smowka is not responsible for downtime caused by force majeure or third-party events.
